Terms and Conditions

ALL QUOTATIONS / ESTIMATES / ORDERS ACCEPTED BY HOBBS WELDING & BOILER SERVICE ARE SUBJECT TO THESE TERMS AND CONDITIONS.

The Seller will behave in a honorably, truthfully, morally upright, accountable, dependable, professional and legal manner in all of our interactions with clients, staff members, and business associates. The seller will not make up claims, misrepresent our goods or services or unnecessarily upsell the buyer and will promote sustainability and economical prudence.
All materials, Parts, and Equipment are warranted by the manufacturer’s warranty and applied to the Buyer only. All labour performed by the Seller is warrantied according to specifications on the agreement or invoice.
Owner will provide space at the job site to permit the contractor to store all materials.
Any material and labor in addition to that specified in this agreement will be furnished only on customer authorization, and will be paid for by the customer as an extra.
Extra labor needed to gain access to equipment if not detailed in quote is not covered. (Eg. Leaking equipment installed behind a wall that must be removed)
Work or repairs made necessary by enforcement of existing or future building/gas/electrical/plumbing codes is not covered.
Repairs due to rust, corrosion, electrolysis, neglect, freezing, poor water quality and obsolescence are not covered.
Unless otherwise specified, prices quoted do not include taxes, duties, tariffs or assessments of any kind or nature. Quotation is valid for 14 days from date of receipt subject to change.
If any given completion date is delayed for any reason beyond the Company’s control (Including but not limited to Fires, water contamination, power failure, power surge, acts of God, inclement weather, accidents, loss or damage of any kind, strikes, or cessation of labour affecting any trade engaged upon the works) a fair and reasonable extension of time for completing the works shall be granted to the Company.
Any provision stipulation or condition which conflicts with or in any way qualifies or negates any of these terms and conditions shall have no effect and these terms and conditions shall prevail. No variation of these terms and conditions shall be valid unless evidenced in writing under the signature of a director of the Company.

I (the “buyer”) agree with the above project and I agree to make payment upon the agreed time frame of payment structure due and net 30 days. I agree that Hobbs Welding and Boiler(the “seller”) retains title to equipment/material furnished until final payment is made. If payment is not made as agreed, the Seller can remove the equipment/material subject to this agreement, and/or pursue additional redress, including but not limited to the placement of liens at the Buyer’s expense. Any damage resulting from removal shall be the responsibility of the Buyer. The Buyer is responsible for any legal fees and costs incurred by the Seller in the performance of this agreement as well as legal fees incurred because of payment not received by the seller. Failure on the part of the buyer to make payment when due shall relieve the seller of the entire obligation of this agreement.

LIMITED WARRANTY: The seller will not be liable for loss or damage consequential or direct, arising from the operation or failure of the apparatus or its controls. The seller highly recommends redundancy within systems for reliability and safety. Labour warranties are void if the unit is worked on by another party other than the seller. Hobbs Welding & Boiler agents or technicians are not authorized to make any warranties on behalf of the seller other than those already contained in the agreement. Any future issues involving service calls that are not related to the equipment installed on this invoice may have Service Fees that follow. All repairs due to the above will be done on a time and materials basis or by bid quotation upon proper authorization by the customer.

This agreement may be terminated without obligation by Hobbs Welding & Boiler Service upon receipt of a 30 day written notice.
